Cargo operations and transfer in the border zone on the territory of the Republic of Belarus

From April 22, 2022, goods vehicles registered in the EU are prohibited from entering and moving around the territory of Belarus. 

The Council of Ministers of the Republic of Belarus adopted the relevant Decree No. 247 "On the movement of vehicles".

The State Customs Committee explained the features of this resolution.

Under what conditions does the ban not apply?

1. If the transport is sent from checkpoints to special zones for re-transfer, transshipment, refueling, etc., as well as from special zones to checkpoints to carry out cargo work.

2. When transporting certain goods:

  • postal items;
  • bulky goods that, for technical reasons, cannot pass through the zones for cargo operations and transfer (if there is a special permit from the Ministry of Transport);
  • vehicles transported in car carriers and car carriers;
  • humanitarian aid shipments;
  • animals and vehicles for their transportation;
  • medicines, medical products and materials for their manufacture;
  • human organs, tissue and blood.

3. When returning to the EU an empty vehicle that has carried the goods listed above.

4. When transiting empty vehicles, which are goods.

5. If buses and cars registered in the European Union move around the Republic of Belarus.

Decree No. 247 features

  • If the Republic of Belarus is not indicated in the CMR as either the country of loading or the country of unloading, it is necessary to obtain a transit permit for transfer on its territory.

  • It is allowed to enter the customs zone of the EAEU in the Republic of Belarus only for carrying out cargo operations and repackaging in specially designated areas, provided that the vehicle subsequently leaves through the same checkpoint through which it entered.

  • Only transfers are allowed in the electronic queue waiting areas. Cargo operations are allowed if these places have customs control zones and special equipment for loading and unloading.

Drafting of documents for cargo handling and transfer

  • For each TSMP, whether it is a container, tractor, trailer or semi-trailer, you need to draw up a separate customs declaration.

  • The transit declaration and CMR must contain information about transhipment, re-coupling and subsequent carrier, if such data is available.

  • If, when entering the customs zone of the EAEU in the Republic of Belarus, the carrier cannot indicate information about the transfer, then they must be entered by the subsequent carrier before registering customs transit for goods.

  • Carriers of empty transport, which is sent to load and export goods, must have a document with them (order-order, contract-application, etc.) to confirm the purpose of entry.

Extension of the period of stay of the TSMP on the territory of the Republic of Belarus

In the event that the vehicle breaks down, gets into an accident or other force majeure situations, it is possible to extend the permitted period for cargo operations and re-transfer.

To do this, you need to submit an application to the head of the customs operations and control department or his deputy at the place where the permit was issued.

Use in internal transportation of trailers, semi-trailers, containers temporarily imported into the customs territory of the EAEU

Carriers that are registered in the territory of one of the countries of the Eurasian Economic Union can make international road transport without special permission:

  • between the EAEU state in which the carriers are registered and another EAEU country;
  • in transit through other countries that are members of the EAEU;
  • between other countries that are members of the EAEU.

When making such transportation, it is necessary to comply with transport legislation.
